New tax legislation not to affect employment migrants’ personal income
An Armenian deputy minister of finance has dispelled the concerns over the proposed amendments to the Income Tax Law, saying that the provision envisaging tax duties will not affect the personal income of the citizens working abroad.
Speaking to reporters at the National Assembly, Vakhtang Mirumyan explained that the income and profit taxes will be charged from the development companies that hire them as contractors. He said that the Government has elaborated stimulating mechanisms to make their registration in Armenia possible.
Noting that most Armenian citizens often leave to work for private entrepreneurs, the deputy minister noted that the proposed legislation does not apply to them as they are not hired as registered workers.
“The citizens who are registered in a foreign organization pay profit tax and have income taxes deduced [from their salaries]. What we propose now is not levying taxes on employment migrants but rather - motivating the owners of foreign organizations to register their businesses in Armenia,” Mirumyan said, adding that they propose reducing the income tax against the backdrop of the proposed profit tax, which is 5%.
“It will motivate them to register employees in Armenia. And the duties which they some way or another pay as income or profit ta, will be paid in Armenia,” he added.
Asked whether any coordination procedures with Russia are necessary, the deputy minister ruled out that need. “Armenia does not have any restriction in terms of defining the rates. That’s the Republic of Armenia’s decision; we do not have any commitment under the Eurasian Economic Union membership treaty to harmonize or not to change [tax] rates. And it is not in conflict with any [of its provisions],” said the official.
Asked whether it implies directing other countries’ budgetary resources to Armenia’s State Budget, the official said he doesn’t absolutely observe such a trend. “Our task is to work in Armenia. As to which countries’ proceeds will be directed to our budget, that’s another aspect of the question,” he added,
As regards ex-premier Hrant Bargratyan’s claims that labor force is liable to taxation, Mr Mirumyan said that labor force is liable to taxation in the countries of registration.
“If your question is about Russia, I can tell you that individuals registered as employees in Russia are liable to 13% income tax because, according to the EEU Agreement, citizens of the EEU member-states employed in other countries are to pay 13% income tax from the very first day. Of course, no organization will register its employee in Armenia under the circumstances.”
As to whether organizations registered in Armenia send their employees to Russia, with no payment to Russia’s state budget, Mr Mirumyan said that the government affords opportunities and it is up to organizations to take them.
“Legal entities carry out their activities and have agreements. An Armenian organization renders services to a foreign one by means of its employees. Therefore, an organization pays taxes in the country where it gets registered.”
