Armenian parliament passes Judicial Code amid strong opposition by minority parties
Armenia’s National Assembly on Wednesday overwhelmingly adopted the Judicial Code under a strong opposition by the minority political parties.
The bill received 72 votes “for” and 10 votes “against”; 10 lawmakers abstained from voting.
The law, which is a constitutional measure, required a ¾ majority of votes to pass the parliament.
In a speech before the voting, Vahe Efiajyan of the opposition Tsarukyan alliance said the approaches in their political team varied with respect to the legislation.
Artak Zeynalyan of the opposition Yelk faction announced their unanimous decision to vote “against”, considering the legitimacy of certain legal provisions "highly questionable".
The new legislation requires that judges be held accountable for all the ECHR rulings against the Republic of Armenia. “It requires accountability measures for absolutely all the judges – from the first instance to the cassation courts. But that accountability should then apply also to the minister of justice, who organized the defense of those acts in the ECHR, as well as [Armenia’s permanent] representative to the Court, who also acts in defense [of the judgements]. So I deny all the arguments brought,” he added.
Edmon Marukyan, another member of Yelk (and lawyer by profession), cited procedural violations in the Code, adding that he had personally turned to the National Assembly’s speaker to call his attention to the fact. “The Judicial Code has certainly its positive aspects too, but the ten proposals, which I earlier submitted, have been totally rejected. That is to say, constitutional laws are adopted without any consensus, without absolutely considering the opposition's proposals,” he said, warning of future possible problems.
President of the National Assembly Ara Babloyan asked the parliament to revise the adopted legislation "to correct the possible inaccuracies online".
