Armenia’s Constitution ‘inadequate tool’ to resolve political problems – expert
Armenia’s current Constitution and legal system do not offer sufficient guarantees for resolving the existing political problems in the country, according to an expert.
“The first thing we need to really focus on is the prime minister's election. Professionally speaking, we can presumably expect the process to take place tomorrow, securing the necessary number of votes. The second process which will follow this will be the cabinet formation and the submission of the [government's ] program to the National Assembly,” Vardan Ayvzazyan, a professor of the Yerevan State University’s Law Department (Chair of Constitutional Law), told reporters.
But he questioned the possibility of program’s approval by the Republican Party (which is still a political majority).
“The Republican does not clearly have an alternative, so they can potentially vote in favor the people’s candidate [Nikol Pashinyan]. Yet, the prime minister’s ability to professionally introduce his program to contribute to state-building processes in Armenia is a completely different issue. I think the society, especially our scientific potential, must be consolidated to offer their assistance to the authorities,” he added.
As a major task for the new government, the expert stressed the importance of specifying the kind of model Armenia should be required to follow as a country (whether socialist or capitalist). He highlighted the need of elaborating a conceptual approach as an underlying principle behind the Constitution.
“The Constitution, as the country's basic law, lays out the key systems for the state, including the political, economic and spiritual-cultural components, human rights, etc. A holistic approach to the Constitution requires that those systems be strictly balanced; however, there isn’t any absolute balance today,” he added.
Addressing Pashinyan’s repeated statements promising to be "only the transitional cabinet’s prime minister", Ayvzazyan said he doesn't consider the argument constitutionally logical.
“The leader of the [civic] movement repeatedly stresses that his cabinet will be temporary to enable him to enhance the existing legislation to ensure the proper conduct of the snap parliamentary election. But we encounter very serious problems here. The Electoral Code, which is considered a constitutional law, requires a 3/5 consent [by parliament] to make the changes possible,” he noted.
