New legislation proposes expanded frameworks for Prime Minister's activities in government
The Ministry of Justice has submitted a draft law on the government institutions' structure in Armenia, proposing several changes in the existing system.
The bill, elaborated under the 2015 constitutional reforms, proposes three posts immediately inferior to the Prime Minister - First Deputy Premier, and two deputy prime ministers.
No changes are envisaged in the cabinet structure, which includes 18 ministries:
1) Ministry of Labor and Social Affairs;
2) Ministry of Health;
3) Ministry of Justice;
4) Ministry of Emergency Situations;
5) Ministry of Foreign Affairs;
6) Ministry of Nature Protection;
7) Ministry of Agriculture;
8) Ministry of Energy Infrastructures and Natural Resources;
9) Ministry of Education and Science;
10) Ministry of Culture;
11) Ministry of International Economic Integration and Reforms;
12) Ministry of Defense;
13) Ministry of Sport and Youth Affairs;
14) Ministry of Diaspora;
15) Ministry of Territorial Administration and Development;
16) Ministry of Economic Development and Investments;
17) Ministry of Transport, Communication and Information Technologies;
18) Ministry of Finance.
No internal structural changes were proposed for any ministry.
The new legislation, if approved, will vest the President of the Republic with the authority to form a cabinet based upon the Prime Minister's proposal.
The Prime Minister will be responsible for making decisions on the Government's domestic and foreign polcies, relying on the latter's program.
The Prime Minister will head the cabinet, coordinating its members' work. A new cabinet will be formed within 15 days after the Prime Minister's appointment. Within a five-day period after his (her) appoinment, the Prime Minster will be obliged to submit a written proposal to the President, naming the candidates for his deputies, and the cabinet ministers.
In the event of the Prime Minister's absence, the First Deputy Prime Minister will replace him or her. The procedures of the replacement will be determined by the chief of cabinet upon his (her) own discretion.
The premier will hold his/her residence in capital Yerevan.
The deputy Mrime Minister may, upon the premier's instruction, undertake the coordination of activities in different government institutions.
After parliamentary elections, the cabinet will submit its resignation to the President at the newly-elected National Assembly's opening session (Article 158 of the Constitution). The same procedure will apply also in case of impeaching the executive and disapproving its program or in the event of the Prime Minister's resignation.
