Armenian government approves redress scheme for survivors of ‘March 1’ events
The Armenian cabinet on Thursday approved a draft law proposing an aid package to the survivors of the March 1-2, 2008 violent post-electoral events in Yerevan.
The measure outlines the form and the amount of the proposed aid, the application form for requesting redress, and the list of other necessary documents.
Minister of Justice Rustam Badasyan, who was the keynote speaker at the event, said the financing will be offered "through budgetary means".
Those who suffered physical damages during the anti-government protests disputing the outcome of the February 19, 2008 presidential election (or their legal successors) may, either personally or through proxies, submit their request to the Ministry of Justice within three years after the entry into force of the decision. The applications of those who are found not entitled to any assistance at all will be rejected. After the acceptance of the requests, the authorized body will, within five business days, transfer the assigned amount to the bank account mentioned by the applicant.
Lump-sum assistance in different amounts will be distributed to the beneficiaries based on the categories outlined below:
1) Legal successor(s) (status is subject determination based on the Criminal Procedure Code of the Republic of Armenia) of an individual who succumbed to the bodily injuries caused by physical violence at the protest site - 30 million Armenian Drams (AMD 476.74 = USD 1)
2) Individual(s) who suffered a grave damage to health– AMD 15 million
3) Individual(s) who suffered a health damage of medium gravity – AMD 5 million.
Prime Minister Nikol Pashinyan highly appreciated the decision as a groundbreaking move, calling at the same time the cabinet’s attention to “several very delicate moments”. “This decision or the established amount do not imply compensation at any rate. In particular, they do not determine the price of a citizen’s life. All that is being formulated just as an assistance,” he said, admitting also his personal engagement and participation in the 2008 post-electoral protests.
“The important thing here is to avoid emotions and move instead to passing balanced decisions,” he said, adding that the European Court of Human Rights will be the authorized body to determine the size of peciniary damage.
