No right to rebel in any international documents – Armenia’s prosecutor general
It is too early to make a legal assessment of the status of the paramedics that arrived at the police building an armed group attacked on July 17.
But if they are kept there against their will and their right to leave the place or move freely is being violated, they can be viewed as hostages, Armenia’s Prosecutor General Gevorg Kostanyan said in an interview with the Shant TV channel.
According to him, a definitive legal assessment of the armed group’s action cannot be made now as new details may be revealed in the course of time.
In response to the anchorman’s question as to the reasons for his long-lasting silence, Mr Kostanyan said:
“Not all should be commented on. As prosecutor’s office we can only response in conformity with the relevant procedure.”
Asked to comment on UN documents with respect to the freedom of rebellion, Kosyanyan said he doesn’t know of such a right in either the domestic legislation or in international laws. “First, no international document - particularly the international treaties ratified by Armenia - allow for any right to rebel. The legislation in Armenia does not allow for that either, as the right to rebel is not a practice of exercising a classically political or a civil right. This is why neither the Convention for the Protection of Human Rights and [Fundamental] Freedoms nor the UN Covenant on Civil and Political Rights make any mention of that,” he said.
The prosecutor general cited the Universal Declaration of Human Rights where he said the use of the word ‘rebellion’ does not absolutely imply a right.
“Speaking about it in a declaration does not mean defining it as a right. Why? Because we see ‘rebellion’ only in the Declaration’s preamble; the text which follows outlines the fundamental human rights.”
The document’s interpretation of rebellion is that of a consequence rather than a right, Kostanyan explained.
Citing the classical definition of the term, Kostanyan said rebellions normally aim to achieve changes in government decisions (as opposed to armed rebellions or armed assaults).
As for disagreements, the prosecutor general said they can be expressed at rallies, protests or other public events allowing people to exercise their right to freedom of speech.
